Musharraf should be put on trial in military court
Local Friday, July 31st, 2009Senior Advocate Akram Sheikh has said that so far no complaint has been filed in the court against former president Gen (r) Pervez Musharraf under the article 6 of constitution and the former president should be held on trial in the military court.
While taking to media outside the Supreme Court of Pakistan, Akram Sheikh said that Musharraf to be tried in the court if case was filed against him under the article 6 of constitution.
He said that the army should be directed to take action against Musharraf as he was army chief and violated the constitution of Pakistan at that time.
Akram Sheik further said that over three hours, he has presented his arguments regarding article 270AAA and suggested the court to form a commission consisting of journalists and lawyers to find and punish the people who had maltreated the judges during the emergency rule.
He said that he has not counted the exact number of PCO judges but he guess that it may be around 100, including the judges of high courts. He said that all 100 PCO judges should leave their offices.
Akram Sheikh said that Court should not allow Musharraf to keep enjoying freedom in the UK after committing so many crimes.
Akram Sheikh said that the judiciary can only take action when a case is presented before it. So far no private complaint has been filed against Musharraf under Article 6. He said that he believe that pronouncement of judgment against a person without a case would be unjust.
Similarly, advocate Hamid Khan while talking to media outside the Supreme Court of Pakistan has said that the court has not given its final verdict yet. He said that the question was that could any verdict be pronounced against Musharraf?
He said that Akram Sheikh has asked for court martial, but our stance is that Musharraf should be tried under high treason charges. Hamid Khan said that Musharraf has violated the constitution and should be tried in this court not in the martial court.
In response to a question he said that obviously, they cannot condone actions of Musharraf’s aids who helped him in overtaking the government.
While replying to another question, Hamid Khan said that PCO judges were not constitutional so there decisions have no validity.
Their public decisions are fine but constitutional verdicts are not valid. Therefore, he thinks that each matter will be separately discussed in the court, he added.
Regarding beating of a policeman and a journalist, he said that the lawyers who indulged in violence are not one of them. He said that such incidents should be probed into. He also requested the president of Lahore Bar Association to personally investigate the incidents as it may be the conspiracy to strip the respect of lawyers.
